Fiqh-e Nizām-e Sīyāsī-ye Islām (Persian: فقه نظام سیاسی اسلام, lit. the jurisprudence of the Islamic political system) is a two-volume book in Persian that discusses some of the most important political topics within Shi’a’s jurisprudence. It is written by Ayatollah Muhsin Araki and printed by publications of Majma' al-Fikr al-Islami and Daftar-e Nashr-e Ma’arif.[1]

About the book

The material for Fiqh-e Nizam-e Siyasi-ye Islam comes primarily from Ayatollah Muhsin Araki's advanced classes in jurisprudence under the same title which have been being compiled since 2012 thanks to the Research Center of The Secretariat of Assembly of Expert for Leadership, Society of Seminary Teachers of Qom, and Supreme Council of Seminary of Qom. In addition to micro-fiqh (the minor contextualization of jurisprudence) and macro-fiqh (the greater contextualization of jurisprudence), concepts such as political philosophy, political worldview and jurisprudence of governing are extensively clarified in these two volumes:[2]

A brief look into volumes

  • Volume one: definitions on politics, political philosophy, political worldview, political system, jurisprudence of the Islamic political system, worldview of religious secularism believing in divinity and intellectual, narrative, traditional and Qur’anic reasoning on God’s perceived exclusive authority.[3]
  • Volume two: self-existent and dependent political power, characteristics of political power, reason for the necessity of the existence of government in human society, the origin for the granted legitimacy of political power, the implied notion of legitimacy or righteousness, the origin of legitimacy, the origin of emergence of political power, descriptive analysis on the origin of political power, value-based and duty-based analysis on the emergence of political power, the commitment for establishing equality unconditionally as required by Islam and methods to administer political power.[4]

Muhsin Araki

Ayatollah Muḥsin Arākī or Mohsen Araki (Persian:محسن اراکی، b. 1955) pursued his education in hawza by taking classes of scholars like Sayyid Abu al-Qasim al-Khoei, Sayyid Muhammad Baqir al-Sadr, Abbas Quchani, Kazim Tabrizi, Sayyid Kazim al-Ha'iri, Husayn Wahid Khurasani, Murtada Mutahhari, Abdullah Jawadi Amuli and Muhammad Taqi Misbah Yazdi. Member of the Assembly of Experts of the Leadership, member of management committee of Society of Seminary Teachers of Qom and former Secretary General of the World Forum for Proximity of Islamic Schools of Thought are among his undertakings. Besides teaching fiqh and principles of fiqh in advanced levels in hawza al-'Ilmiyah, Ayatollah Araki has authored several books and articles including: Fiqh-e Nizam-e Siyasi-ye Islam, Hiwar fi al-Imamah, Nazariyyah al-Hukm fi al-Islam, Nigahi bi Risalat wa Imamat and al-Wilayah al-Ilahiyyah wa Wilayah al-Faqih.[5]
